Employee Reporting

Employee reporting enable the university to respond to concerns, meet legal obligations, and connect individuals who have been harmed with support and resources.

All non-confidential U-M employees (faculty and staff, including student employees) are required to share with the Equity, Civil Rights, and Title IX Office (ECRT) information they learn in the scope of their employment about alleged sexual misconduct and protected class discrimination, harassment or retaliation by members of the university community.

Employees are required to report within 48 hours of receiving information. This includes information learned through direct disclosures or other parties.

When employees share information with ECRT it enables the university to follow up with the person to ensure the individual receives comprehensive information about resources, supportive measures and resolution options.

What to do if you learn of prohibited conduct?

Employees should report information using the Report a Concern form or by emailing or calling ECRT. Be sure to include your name, contact information and any relevant information such as the name(s) and/or university affiliation of the individuals involved and/or who shared the information with them. Reporting Exemptions

Employees may, but are not required to, report disclosures when they happen under certain, generally uncommon, scenarios:

  • Classroom discussions, in an assignment for class, in discussion outside of class, or as a part of a research project directly related to the class (for example, a person discloses a personal experience of sexual misconduct in a written assignment related to the neurobiology of trauma, or a classroom discussion about course material related to sexual violence);
  • Institutional Review Board (IRB) approved research project – Unless otherwise provided in the IRB-approved consent, during a non-minor participant’s involvement as a subject in an IRB-approved human subjects research protocol (IRB Research), even when such disclosure would otherwise be considered received within the scope of the employee’s employment
  • Sexual misconduct public awareness events (ex: Take Back the Night or events organized by confidential resources)

Confidential Resources

Employees serving in roles designated as confidential resources (noted below and under the policies) will remain exempt from reporting requirements.

  • Office of Counseling and Workplace Resilience
  • Person of Confidence Program
  • Sexual Assault Prevention and Awareness Center (SAPAC)
  • Spectrum Center
    • The following staff within Spectrum Center are Confidential Resources:
      • Director
      • Associate Director
      • Support Services and Wellness Advocate
      • Educational Engagement Program Manager
  • Staff Ombuds
  • University Faculty Ombuds
  • University Health & Counseling (UHC)

Training

All faculty and staff are strongly encouraged to complete the Reporting Sexual and Gender-Based Misconduct module on an annual basis to understand what reporting obligations they may have, the conduct covered under the Policy, and how to respond appropriately and report concerns.
